Attorney James Logan, one of our discrimination lawyers, served as primary plaintiff's counsel in the age discrimination case known as Harbison-Walker Refractories v. Brieck and argued before the Supreme Court of the United States in 1988. The issue, argued successfully by Mr. Logan—who prevailed by an 8-1 vote in his client's favor—involved the quantity and quality of indirect, circumstantial evidence which an age discrimination plaintiff must introduce in order to avoid the employer's efforts to get the case dismissed without having to face a jury. The legal arguments advanced by Mr. Logan in Harbison-Walker Refractories v. Brieck are still the law today.
